3. Client Responsibilities

To ensure the successful completion of landscaping projects, clients are expected to:

Obtain any necessary permits or approvals required for landscaping work.
Timely make payments as outlined in the payment terms.

3.1. Site Preparation

4. Payment Terms

Landscapers Hampstead offers flexible payment options to accommodate our clients' needs. The payment structure typically includes:

Deposit: A non-refundable deposit of 30% of the total project cost is required to secure scheduling and initiate planning.
Progress Payments: For larger projects, incremental payments may be scheduled based on project milestones.
Final Payment: The remaining balance is due upon satisfactory completion of the project.

4.1. Late Payments

Late payments may incur additional charges, including interest, as specified in the invoice. Continued non-payment may result in project delays or termination of services.

5. Cancellation Policy

Clients have the right to cancel a service agreement under the following conditions:

Written notice must be provided at least two weeks prior to the scheduled start date.
The initial deposit is non-refundable unless cancellation occurs within seven days of the deposit.
Additional fees may apply for work already commenced or materials purchased.

5.1. Termination for Breach

6. Warranty and Liability

6.1. Insurance Coverage

We maintain comprehensive insurance to protect against accidental damage during the execution of our services. Clients are advised to verify their own insurance coverage for their property.

7. Dispute Resolution

In the event of a disagreement or dispute, both parties agree to seek resolution through the following steps:

Initial discussion to address and resolve the issue amicably.
Mediation involving a neutral third party if the dispute remains unresolved.
Legal action as a last resort, subject to the jurisdiction of Hampstead courts.

7.1. Arbitration

Should mediation fail, both parties agree to binding arbitration to settle the dispute outside of court.

8. Changes to Terms and Conditions

Landscapers Hampstead reserves the right to modify these Terms and Conditions at any time. Clients will be notified of significant changes through email or other communication channels. Continued use of our services after such modifications constitutes acceptance of the new terms.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any legal actions or proceedings arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts in Hampstead.

10. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the course of the project. This includes, but is not limited to, design plans, business strategies, and personal data.

11. Intellectual Property

12. Force Majeure

Landscapers Hampstead is not liable for any failure to perform its obligations under these Terms and Conditions due to circumstances beyond its reasonable control. Such circumstances include, but are not limited to, natural disasters, pandemics, governmental restrictions, and acts of terrorism.

12.1. Notification of Force Majeure

No failure or delay by either party in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise preclude any other or further exercise of the same or any other right.
